General Terms and Conditions (GTC) of Pharmacy

I. Scope

For all business transactions with Aktive Healthcare Limited, the following terms and conditions of delivery and payment apply exclusively; any verbal ancillary agreements must be confirmed in writing by Aktive Healthcare Limited.

For all offers and orders from Aktive Pharmacy, the following terms and conditions of delivery and payment apply in addition to the terms and conditions in the order confirmation.

II. Conclusion of contract

1. If prescription medications are ordered, an e-prescription or a paper prescription must be provided to Aktive Pharmacy. Then, Aktive Pharmacy will review the prescriptions. Upon acceptance of the order, the customer will receive an electronic confirmation.

2. The representations of non-prescription medicines or other products in the online shop do not constitute legally binding offers. By clicking the "Pay now securely / Order with payment" button, the customer places a binding order for the goods contained in the shopping cart. Upon acceptance of the order, the customer receives an electronic confirmation.

3. Customers can place orders by mail, telephone, email, or through the pharmacy area within the apomeds.com website. After each order, the customer receives an order confirmation.

4. The customer can only order medicines mentioned on the prescription or shown in the online shop. If the prescription specifies an active ingredient, Aktive Pharmacy will select an available generic medicine.

5. Should a pharmaceutical or other product become unavailable due to force majeure or production cessation, and Aktive Pharmacy is unable to procure the ordered goods under reasonable conditions, the circumstances occurred after the contract was concluded, and Aktive Pharmacy is not responsible for the non-delivery, Aktive Pharmacy shall be released from its delivery obligation. Aktive Pharmacy will inform the customer immediately. Any consideration paid by the customer will be reimbursed immediately.

6. Return Policy Exceptions: Due to the temperature-sensitive nature of the product, weight loss treatments such as Wegovy, Mounjaro, or Saxenda must be used immediately upon receipt or properly disposed of. Therefore, Aktive Pharmacy cannot accept returns or issue refunds once the product has been shipped, regardless of the condition of the package seal.

III. Other delivery conditions

1. The medicines or other products to be supplied by Aktive Pharmacy will be delivered by parcel via a contracted transport company to the specified delivery location within Germany. Standard delivery takes 1-2 business days. If you, as a customer, require express delivery, you must select this delivery method when placing your order.

2. Aktive Pharmacy will inform you as a customer of any delivery restrictions at the latest at the end of the ordering process.

3. Standard delivery of prescription drugs from Aktive Pharmacy is free of shipping costs. For express deliveries, the shipping fee is displayed during the ordering process.

4. Successful delivery will be confirmed by the commissioned transport company.

IV. Terms of payment

1. The prices valid at the time the customer submits the offer apply. All prices include VAT.

2. The purchase price is due upon conclusion of the contract. Aktive Pharmacy may authorise third parties to collect the purchase price claim.

V. Retention of title

The delivered products remain the property of Aktive Pharmacy until the purchase price has been paid in full.

VI. Limitations of Liability

Given the current state of technology, communication via the internet cannot be guaranteed to be completely error-free and/or available at all times. Aktive Pharmacy therefore assumes no liability for the constant and uninterrupted availability of the online ordering system, nor for technical and electronic errors over which Aktive Pharmacy has no control. This also applies to delayed order processing.

VII. Liability for defects

The statutory liability for defects applies. If a guarantee is included in the product description, the customer's statutory rights against us remain unaffected.

VIII. Applicable Law, Severability Clause

UK law applies to the business relationship between Aktive Pharmacy and the customer, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). The choice of law does not deprive the consumer of the protection afforded by those provisions from which no derogation by agreement is permitted under the law that would apply in the absence of a choice of law. Furthermore, the choice of law does not affect the application of the mandatory international provisions of the law of the court seized.

Should any provision of these General Terms and Conditions be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. The statutory provisions shall apply in place of the invalid provision.

IX. Dispute resolution

We are obliged to participate in a dispute resolution procedure before the Dutch Consumer Dispute Resolution Board (Geschillencommissie Zorg Algemeen Postbus 90600, 2509 LP The Hague, https://www.degeschillencommissiezorg.nl/english/) if the dispensing or sale of medicinal products and medical devices is concerned.

X. Data protection

All information on the processing of personal data can be found in the privacy policy.

Cancellation policy

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period shall be fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the first goods.

by means of a clear statement (e.g., a letter sent by post or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but this is not mandatory.

To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of cancellation before the expiry of the cancellation period.

Consequences of revocation

If you cancel this contract, we will refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us promptly and in any event no later than fourteen days from the date on which you notify us that you have cancelled this contract. This deadline is met if you send the goods before the expiry of the fourteen-day period. You will bear the direct cost of returning the goods. You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary to check their quality, properties and functioning.

Exclusion of the right of withdrawal

The right of withdrawal does not apply to the following contracts:

Contracts for the supply of sealed goods which, for reasons of health protection or hygiene, are not suitable for return if their seal has been removed after delivery.

Contracts for the supply of goods that are subject to rapid perishability or whose expiration date would be quickly exceeded. This particularly applies to pharmaceuticals and products that require refrigerated transport and storage, e.g., medications for weight loss treatments.
