1.2. Scope of data processing, processing purposes, and legal bases
The scope of data processing, processing purposes, and legal bases are explained in detail below. The following are generally considered to be the legal basis for data processing:
- Art. 6(1)(a) GDPR serves as the legal basis for processing operations for which we obtain consent.
- Art. 6 (1) (b) GDPR is the legal basis insofar as the processing of personal data is necessary for the performance of a contract, e.g. if a website visitor purchases a product from us or we perform a service for them. This legal basis also applies to processing that is necessary for pre-contractual measures, such as enquiries about our products or services or for clarifying technical problems during the ordering process.
- Art. 6 para. 1 sentence 1 lit. c GDPR applies if we fulfil a legal obligation by processing personal data, as may be the case in tax law, for example.
- Art. 6 (1) (f) GDPR serves as the legal basis if we can invoke legitimate interests for the processing of personal data, e.g. for cookies that are necessary for the technical operation of our website.
1.3. Data processing outside the EEA
Insofar as we transfer data to service providers or other third parties outside the EEA, we guarantee the security of the data during transfer, insofar as (e.g. for the United Kingdom, Canada and Israel) adequacy decisions of the EU Commission (Art. 45 (3) GDPR) are available.
This may lead to risks for users, e.g. because it is more difficult to enforce their rights or because government agencies have access to the data.
If no adequacy decision exists (e.g. for the USA), the legal basis for data transfer is usually standard contractual clauses, unless we indicate otherwise. 1.4. Storage period

1.9. Customer surveys
From time to time, we conduct customer surveys to get to know our customers and their wishes better. In doing so, we collect the data requested in each case. It is in our legitimate interest to get to know our customers and their wishes better, so that the legal basis for the associated data processing is Art. 6 (1) (f) GDPR. We delete the data once the results of the surveys have been evaluated.

Interested parties have the option of subscribing to a free newsletter. We process names and email addresses exclusively for the purpose of sending the newsletter. Registration takes place by selecting the appropriate field on our website, by ticking the appropriate box in a paper document or by another clear action, whereby interested parties declare their consent to the processing of their data, so that the legal basis is Art. 6 para. 1 sentence 1 lit. a GDPR. Consent can be revoked at any time, e.g. by clicking on the corresponding link in the newsletter or by sending a message to our email address given above. The processing of data until revocation remains lawful even in the event of revocation.
On the basis of the consent of the recipients (Art. 6 (1) (a) GDPR), we also measure the opening and click rates of our newsletters in order to understand which content is relevant to our recipients.

The provider processes content, usage, meta/communication data and contact data in the USA. The security of the data transferred to the third country (i.e. a country outside the EEA) is guaranteed by standard data protection clauses (Art. 46(2)(c) GDPR) agreed by the EU Commission as part of the review procedure under Art. 93(2) GDPR, which we have agreed with the provider.
3.1. Note for website visitors from Germany
Our website stores information on the end device of website visitors (e.g. cookies) or accesses information that is already stored on the end device (e.g. IP addresses). The following sections provide details on what information this is.
This storage and access is based on the following provisions:

We have a legitimate interest in using sufficient storage and delivery capacities to ensure optimal data throughput even during peak loads. The legal basis for the data processing described is therefore Art. 6 (1) (f) GDPR.
The legal basis for the transfer to the USA is standard contractual clauses. The security of the data transferred to the third country (i.e. a country outside the EEA) is ensured by standard data protection clauses (https://ec.europa.eu/info/ law/law-topic/data-protection/international-dimension-data-protection/standard-contractual-clauses-scc/standard-contractual-clauses-international-transfers_en ) adopted in accordance with the examination procedure pursuant to Art. 93(2) GDPR (Art. 46(2)(c) GDPR), which we have agreed with the provider.
3.4. Customer account
Visitors to the website can open a customer account on our website. We process the data requested in this context on the basis of our legitimate interest (Art. 6(1)(f) GDPR) in enabling website visitors to request medical services or order prescription medicines and process the account data in this context. This also applies to the use of the telephone number stored in the customer account to contact the customer in the event of a technical problem during the services or ordering process.
3.5. Google single sign-on procedure
Visitors to the site can log in to our website using a single sign-on procedure. To do so, they use the login details they have already created for another provider. The prerequisite is that the site visitor is already registered with the respective provider. When a site visitor logs in using the single sign-on procedure, we receive information from the provider that the site visitor is logged in with the provider, and the provider receives information that the site visitor is using the single sign-on procedure on our website. The data is processed for the purpose of fulfilling the contract concluded with the respective website visitor (Art. 6(1)(b) GDPR). 3.7. Advice from doctors
Visitors can also ask doctors for advice via a link on our website. By clicking on the button on our website that redirects visitors to Health & Go for telemedical services provided by doctors, visitors are redirected to the Health & Go website. Health & Go is responsible for processing the personal data of visitors to the website. Doctors can also prescribe medication to visitors to the website. The data is processed for the purpose of fulfilling the contract concluded with the respective visitor (Art. 6(1)(b) GDPR). Insofar as health data is processed in this context, the legal basis is Art. 9(1)(h) GDPR.
3.8. Use of the online pharmacy and/or doctor service
When using the online pharmacy, personal data is processed in order to identify individuals for the use of the online pharmacy.
The following data is processed:

Apo Global, Apomeds NL B.V. and Apomedical Israel Ltd., Israel, cooperate with each other. Due to the close cooperation between the companies, corporate agreements have been concluded, in particular agreements pursuant to Article 26 GDPR, which provides a legal framework for transferring data and processing it in integrated teams (Article 6(1)(f) GDPR).
The cooperation also affects your use of Health & Go. If you click on the button on our website to be redirected to Health & Go. for telemedical services provided by doctors, you will be taken to the Health & Go. website. Health & Go. is responsible for processing your personal data on its own website. We only process your order or prescription data if you click on the “Order” button on the Health & Go. website. 3.11. Technically necessary cookies
Our website uses cookies. Cookies are small text files that are stored in the web browser on the end device of a site visitor.
